By booking, the passenger confirms that they have read, understood and accepted these GTC.
The contract is concluded at the time the passenger makes a firm reservation for the flight. If any of the provisions of these GTC are found to be invalid or unenforceable in whole or in part, the validity and effectiveness of the remaining provisions shall remain unaffected.
The pilot is the commander of the tandem glider and the passenger undertakes to follow his instructions.
The passenger certifies that they do not suffer from any health problems (of a psychological or physical nature) that could have an impact on the safe conduct of a tandem flight with a tandem glider.
The passenger is aware that tandem flights with a paraglider involve risks. Under a paraglider, the legs of the pilot and passenger form the landing gear, for example, which can lead to injury in the event of a hard landing or an aborted take-off. In addition, risks due to the sudden and unpredictable influence of the wind cannot be excluded. 2ForFly and its pilot Mathieu Soulier have taken out liability insurance of 5 millions CHF for non-commercial flights and 10 millions CHF for commercial flights. In the event of personal injury or material damage suffered by the passenger during a flight in a paraglider, the liability of 2ForFly and its pilot Mathieu Soulier is limited to the amount corresponding to the type of flight concerned.
Passengers who are minors or under guardianship require an authorization from the person with parental authority or a legal representative. If such a person is not present at the time of the flight, a written declaration of consent must be presented to 2ForFly and its pilot Mathieu Soulier beforehand.
The dates for the tandem flights are fixed in advance, sometimes at short notice. A fixed date can be changed when weather conditions or organisational reasons require it. The final decision as to whether or not a flight can take place is the sole responsibility of the pilot.
If the passenger cancels the flight when it would have been possible to carry out, the following rules apply with regard to refunding the price of the flight:
In case of cancellation more than 3 days before the scheduled date, the full price of the flight will be refunded.
In case of cancellation more than 24 hours before the scheduled time, 50% of the flight price will be refunded.
In case of cancellation less than 24 hours before the scheduled time, the price of the flight will not be refunded.
2ForFly and its pilot Mathieu Soulier have taken out accident insurance for the passenger, the scope of which is limited to Switzerland and the maximum amount covered is 100,000 CHF for recovery costs. Benefits from this accident insurance can be claimed once the benefits from any passenger accident insurance have been exhausted. The liability of 2ForFly and its pilot Mathieu Soulier for claims arising from the consequences of an accident is limited to the benefits covered by the insurance in the context of the tandem flight and the maximum cover provided by the insurance.
The pilot decides whether and how mobile phones and cameras may be carried.
In the event of any dispute arising from the tandem flight, passengers from the USA and Canada explicitly waive any jurisdiction in the USA or Canada and are aware that neither the company 2ForFly nor its pilot Mathieu Soulier will accept jurisdiction in the USA or Canada.
Only the ordinary courts of law for the headquarters of 2ForFly in Lausanne are entitled to adress any dispute arising from the contract concluded for the tandem flight. Only Swiss law is applicable.
